Jeff Meijers v. People's Health Center

IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF NEBRASKA

April 25, 2013

JEFF MEIJERS,
PLAINTIFF,
v.
PEOPLE'S HEALTH CENTER, AND REDDY, DENTIST, EMPLOYEE, DEFENDANTS.

The opinion of the court was delivered by: John M. Gerrard United States District Judge

MEMORANDUM ) AND ORDER

This matter is before the court on its own motion. On March 12, 2013, the court conducted an initial review of Plaintiff's Complaint and found that it failed to state a claim upon which relief may be granted. (Filing No. 6.) The court gave Plaintiff an opportunity to amend his Complaint, but warned Plaintiff that if he failed to amend by April 15, 2013, his claims would "be dismissed without further notice for failure to state a claim upon which relief may be granted." (Id. at CM/ECF p. 4.) Plaintiff has failed to file an amended complaint.

IT IS THEREFORE ORDERED that:

1. This matter is dismissed without prejudice because Plaintiff failed to prosecute this matter diligently and failed to comply with this court's orders.

2. Defendants' Motion to Dismiss (filing no. 7) is denied as moot.

3. A separate judgment will be entered in accordance with this Memorandum and Order.
