PRELIMINARY ORDER OF FORFEITURE

This matter comes on before the Court upon the United States' Amended Motion for Issuance of Preliminary Order of Forfeiture (Filing No. 24). The Court reviews the record in this case and, being duly advised in the premises, finds as follows:

1. The Defendant has entered into a Plea Agreement (Filing No. 22) whereby he has agreed to plead guilty to Count I and the Forfeiture Allegation of the Indictment filed herein. Count I charged the Defendant with transportation in interstate commerce with intent to promote prostitution, in violation of 18 U.S.C. §§ 2421 and 2. The Forfeiture Allegation sought the forfeiture, pursuant to 18 U.S.C. ' 2428, of the following properties on the basis they were used or were intended to be used to facilitate said violation or constitute property derived from proceeds traceable to the violation alleged in Count I.

a. $4,037 in United States Currency;

b. Silver Sony Laptop Computer, Model #PCG3A4L;

c. Black iPhone IV Cell Phone, Model A1349;

d. Black Samsung Metro PCS Cell Phone, Model SCH-R910;

2. By virtue of said guilty plea, the Defendant forfeits his interest in the above-described properties, and the United States should be entitled to possession of said properties, pursuant to 18 U.S.C. ' 2428.

3. The United States' Motion for Issuance of Preliminary Order of Forfeiture should be granted. Accordingly,

IT IS ORDERED:

A. The United States' Amended Motion for Issuance of Preliminary Order of Forfeiture (Filing No. 24) is hereby granted, and the United States' Motion for Issuance of Preliminary Order of Forfeiture (Filing No. 23) is denied as moot.

B. Based upon the Forfeiture Allegation of the Indictment and the Defendant's plea of guilty, the United States is hereby authorized to seize the following properties:

1. $4,037 in United States Currency;

2. Silver Sony Laptop Computer, ...
